Description

Monthly membership will auto-renew each month until cancelled within the terms of this agreement. Membership begins on the sale date of the membership.

All class pass/monthly plan purchases are final sale and we do not offer refunds for any class purchases.

Classes are non-transferrable or sharable.

This Membership Agreement (hereinafter referred to as “Agreement”) is entered into by and between Northern Grrrls LLC, dba Ignite Fitness (hereinafter referred to as “Ignite Fitness”) and the Member (herein referred to as “Member”). In this agreement, the terms “you” and “your” refer to the Member.

The Obvious Stuff

You understand that it is your responsibility to attend instruction sessions.

You understand that the entire class fee stated is due and payable according to the terms of this agreement whether or not you choose to attend instructional sessions provided by Ignite Fitness.

The hours of operation and class schedule may be changed at the discretion of Ignite Fitness. Class pass packages will not be charged if we must cancel a class.

Automatic Billing

Monthly plans are automatically billed each month on the same day to your credit card on file. Ignite Fitness does not credit or refund for any charges that have already been processed. A charge of $25 will be made for any checks/payment returned due to non-payment.

Use Your Classes, Don’t Loose ‘Em

Monthly plan classes do not roll over. Ignite Fitness does not offer refunds or credits for any unused classes.

Class Cancellation Policy

Ignite Fitness has a twelve-hour class cancellation policy. You have up to 12 hours before class starts to remove your name from the class list and get that class back on your account. If you remove your name after this period, you will be charged for the class. Students with unlimited membership are allowed four (4) late cancels per month and then will be charged an additional $20 fee for that month for any late cancellations beyond the allowance.

Sharing Is Caring, But This Membership Is Yours

It is expressly understood and agreed that this Agreement is not assignable or transferable by the Member and no rights or privileges granted by this Membership can be transferred or assigned by the Member.

Unlimited Plan $70/month
 Includes multiple in studio classes per day and unlimited virtual classes
 Auto renews every 30 days for up to two years.
 Classes expire in 30 days

Class Packages

Expires 2-5 months from purchase depending on package. Please review your receipt for exact dates. Class packages activate on the date of purchase.
 All class packages cannot be shared unless requested and approved.
 Unused classes cannot be transferred or refunded

No Hassel Freezes

You can freeze your contracted unlimited membership for a duration of two (2) weeks at no cost or penalty if you need time off due to pregnancy, suffer a chronic illness or suffer a chronic injury. Chronic is defined as greater than 30 days. These freezes are always complimentary if you provide a note from your doctor detailing the medical necessity of the freeze. Your billing will be suspended for the duration of the freeze and will automatically resume once the freeze period has ended.

Please allow five (5) business days for us to process the freeze.

CANCELLATIONS AND REFUNDS: Please Stay… But if You Must Go

All Unlimited memberships are set to auto renew at the end of the contracted period to allow for continuous access to classes and services. If you do not wish for your Unlimited membership to auto renew, please email [email protected] to assist in the cancellation within 30 days of the next scheduled payment date. Ignite Fitness requires five (5) business days to process the cancellation. Any remaining classes not used by the member will not be reimbursed.

No Fee Termination of a Unlimited Membership

You may terminate your contract within three (3) business days after receiving a copy of the contract or agreeing to contract online.

You may terminate an Unlimited membership, without any fees, if you become disabled during the contracted period or move your residence greater than 25 miles from Ignite Fitness.

Buyer’s Right to Cancel

If you wish to cancel this contract, you may cancel by emailing [email protected] or mailing a written notice by certified or registered mail to the address specified below. The notice must say that you do not wish to be bound by this contract and must be delivered or mailed before midnight of the third operating day after you sign this contract. If the facilities or services that are described in the contract are not available at the time you sign the contract, you have until midnight of the 3rd operating day after the day on which you received notice of their availability, to cancel the contract. If within this time period you decide you want to cancel this contract, you may do so by notifying Ignite Fitness Studio by any writing mailed or delivered to Ignite Fitness at the address shown below on the contract, within the previously described time period. If you do so cancel, any payments made by you, less a user fee of no more than $3 per day of actual use, will be refunded within 21 days after notice of cancellation is delivered, and any evidence of any indebtedness executed by you will be canceled by Ignite Fitness and arrangements will be made to relieve you of any further obligation to pay the same. You may also cancel this contract if you relocate your residence further than twenty-five miles from any health club operated by the seller or from any other substantially similar health club which would accept the obligation of the seller.

This contract may also be cancelled if you die, or if the health club ceases operation at the location where you entered into this contract. If you become disabled, you shall have the option of (1) being relieved of liability for payment on that portion of the contract term for which you are disabled, or (2) extending the duration of the original contract at no cost to you for a period equal to the duration of the disability. If any of the facilities or services described in the contract become unavailable or are no longer fully operational, before full receipt of the services and use of facilities for which the buyer contracted, the buyer is liable for only that portion of the total consideration proportional to the elapsed time portion of the contract at the time of the unavailability. The buyer is entitled to a refund of any other funds already paid.

You must prove such disability by a doctor's certificate, which certificate shall be enclosed with the written notice of disability sent to Ignite Fitness. Ignite Fitness may require that you be examined by another physician agreeable to you and the health club at its expense. If cancellation is for death or disability, the health club may keep or collect an amount equal to the fair market value of the services or use of facilities you have already received.

Please Be Nice and Follow the Rules

You agree to abide by the rules and regulations governing the conduct and operation of instruction sessions, students, and observers, now and those prescribed in the future by Ignite Fitness. You acknowledge that rules and regulations governing the gym may be changed from time to time, and agree to abide by all such rules and regulations as adopted or hereinafter amended. Ignite Fitness reserves the right to revoke or terminate your membership in the event that you fail to abide by the rules and regulations, or for any other reason.

Watch Your Stuff

Ignite Fitness, its agents, employees and landlords shall not be responsible for damaged, lost or stolen articles, whether inside or outside the Ignite Fitness facility.

Smile. You’re On Camera.

You agree to authorize Ignite Fitness, its successors and assigns, and those acting under its authority, to copy, use, publish for art, advertising, trade, or any other lawful purpose whatsoever, photographic portraits, pictures or video of you, in which you may be included in whole or in part.

Heavy weights and drugs don’t mix.

You agree that while you are using the Facility or participating in a training session to refrain from the use of and that you will not be under the influence of any medication that may impair your physical or mental capabilities, alcohol, or drugs.

You acknowledge and agree that such use or influence may increase the risk of serious bodily injury or death to yourself or others.

The Liability Waiver

Member agrees and understands that the use of Ignite Fitness, the equipment therein and the exercises and activities to be done by the Member involve a degree of risk including, but not limited to, injury, accident, death, loss, and cost or damage to my person or property. Member also agrees and understands the risk of transmission of infectious disease, whether related to the novel coronavirus SARS-CoV-2 or other pandemics, viruses, disease outbreaks, epidemics, public health emergencies and/or otherwise.

Member expressly agrees the Member assumes any and all risks related to the use of all of Ignite Fitness’s facilities, Ignite Fitness sponsored activities and/or any transportation provided by the Ignite Fitness, even if the risk was created by the NEGLIGENCE of Ignite Fitness, or an agent or employee thereof.

Accordingly, Member releases, indemnities, discharges, absolves and holds harmless Ignite Fitness, building owners, employees, instructors, assigns officers, shareholders, partners, and successors, from any and all claims, suits demands, cause of action damages or liability arising out of or in any manner related to any activity engaged in by the Member at Ignite Fitness or the use of any of its facilities, even if the risk was created by the NEGLIGENCE of Ignite Fitness, or an agent or employee thereof. By signing this agreement, Member agrees that he or she will not sue the Ignite Fitness for money damages for personal injury sustained by the Member even if due to the NEGLIGENCE of Ignite Fitness. By purchasing this class pass, Member understands that he or she is giving up substantial legal rights.

Enforcement

If any provision of this Agreement is held to be invalid or unenforceable by a court of competent jurisdiction, such holding shall not affect the validity or enforce ability of any other provision, which shall remain in full force and effect, and the provision held invalid or unenforceable shall be deemed modified so as to give the provision the maximum effect permitted by applicable law.

Governing Law

This agreement shall be governed by the laws of the State of Wisconsin.

This Agreement comprises the entire agreement pertaining to membership of any other relationship between the parties, and no other agreement of any kind will be recognized.

By purchasing a punch pass or membership you agree you have read and understand the terms of this agreement and agree to its provisions.
